Dostana Import Export GmbH uses Shopify as the technical platform to provide these Services.

SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you confirm that you are of legal age in your country of residence or have obtained the consent of your legal guardians.
Use of our Services may require the provision of certain information, particularly regarding billing, payment, and delivery. You represent and warrant that all information you provide is accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
SECTION 2 – OUR PRODUCTS
We strive to display our products as accurately as possible. Variations in color, appearance, or presentation may occur due to device settings and display differences.
Product descriptions, assortments, and availability may be changed at any time without prior notice. We do not guarantee the continuous availability of specific products.
SECTION 3 – ORDERS
By submitting an order, you make a binding offer to purchase. The contract is concluded once we confirm your order by email or dispatch the goods.
Cancellations after acceptance of an order are generally excluded.
Returns or exchanges are governed exclusively by the withdrawal provisions set out in these Terms.
Our products are intended solely for private consumers. Commercial resale is not permitted.
SECTION 4 – PRICES, TAXES, AND DEPOSIT CHARGES
All prices are stated in Euros and include statutory VAT, excluding shipping costs.
Deposit Charges
A statutory deposit of €0.25 per container unit is charged on beverages subject to Germany's deposit system.
Deposit containers can be returned at standard deposit return machines throughout Germany, including supermarkets, discount stores, and beverage retailers. Deposit refunds are processed directly by the respective retailer.
SECTION 5 – SHIPPING AND DELIVERY
Shipping is available exclusively within Germany.
Shipping costs are €5.95. Orders above €39 qualify for free shipping, excluding heavy products.
Additional Charges
Heavy Products (e.g., rice or flour bags weighing 5 kg or more):
Additional heavy goods surcharge of €5.00 per order.
Frozen Products:
One-time surcharge of €5.00 per order for special packaging (not charged per item).
The maximum parcel weight is 31.5 kg.
Fresh vegetables are shipped exclusively from Monday to Thursday.
Same-Day Delivery (Hamburg)
Cost: €30.00
Orders must be placed by 5:00 PM.
For orders placed later, customers are requested to contact us by phone. We will do our best to accommodate requests whenever possible.
Delivery times are non-binding estimates. Once the shipment has been handed over to the carrier, the risk passes to the customer.
SECTION 6 – INTELLECTUAL PROPERTY
All content provided through the Services is the intellectual property of Dostana Import Export GmbH or its licensors and may not be used without prior written consent.
SECTION 7 – DEFECT NOTIFICATION AND COMPLAINTS
Customers are required to inspect the goods immediately upon receipt.
Obvious defects, transport damage, or incorrect deliveries must be reported within 24 hours of receiving the goods.
Reports submitted after this period may not be considered.
SECTION 8 – RIGHT OF WITHDRAWAL AND RETURNS
Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
- Fresh food products
- Frozen products
- Chilled goods
- Perishable goods
- Goods unsuitable for return for reasons of hygiene or health protection
These products are completely excluded from return shipping.
Return Shipping Costs
Where a right of withdrawal exists, return shipping costs shall be borne by the customer.
Returns sent freight collect will not be accepted.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Dostana Import Export GmbH uses Shopify as a technical platform. Purchase agreements are concluded exclusively between the customer and Dostana Import Export GmbH. Shopify assumes no liability for transactions conducted through this store.
SECTION 10 – DATA PROTECTION
Personal data is processed in accordance with our Privacy Policy and Shopify's Privacy Policy.
SECTION 11 – LIABILITY
We are fully liable in cases of intent and gross negligence.
In cases of slight negligence, liability shall only apply in the event of a breach of essential contractual obligations and shall be limited to foreseeable damages.
SECTION 12 – FINAL PROVISIONS
German law shall apply, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
